Nazi war criminal Nikolaus Schiffer proved that is possible to be born in America and still become an illegal alien in the United States. How did he do this? By joining the Romanian Army in 1943 he relinquished his US citizenship and became an enemy combatant. During that time period he was part of a unit responsible for exterminating Jews and by taking part in that voluntarily Schiffer became subject to a US immigration law that makes anyone who voluntarily helped Hitler carry out the Holocaust an illegal alien subject to immediate deportation.

During the course of the proceedings Judge Franklin S. Van Antwerpen said that even though he was born in Philadelphia to German parents and never formally renounced his citizenship that his actions were so "obnoxious" that they qualified as proof that he intended to relinquish his citizenship. After the war Schiffer came back to America and failed to disclose his Nazi activities which would have prevented him from being able to enter the country. He eventually became a naturalized citizen in 1958, but Van Antwerpen revoked that and he was eventually deported back to Romania in 2002.
